AdminHistory | In 1980-1981 Robert Paterson Ltd constructed a facotry unit at 53 Kirkton Campus on behalf of the Livingston Development Corporation. the contract consisted of two parts A) for roads, drainage and civil works and B) the buildings. As was usual a number of sub-contractors were used on the works.
Paterson encountered difficulties and completion of the works was delayed by 17 weeks. Paterson had sought an extension of time based on inclement weather, late instructions, difficulties with the temporary access road and with a number of the nominated sub-contractors. The Corporation rejected these claims, but in 1987 Paterson referred the case to arbitration, seeking £250,000.
Although the Corporation felt that the work of Paterson could be criticised in a number of ways, there had been several issues with sub-contractors in 1981, which, by 1989, the Corporation felt it had acted unreasonably. After five days of evidence were given at arbitration in 1989, the Corporation sought a settlement of £80,000, which was subsequently agreed with Paterson. |
