AdminHistory | The legal department represented the Corporation's legal interests in all matters, including in contract disputes and debt recovery. The majority of its more complex legal cases came from contract disputes and the aspect of liability when certain projects were delayed or suffered from defective workmanship.
There were two major cases during the Corporation's existence. The first was the construction of the Jesperson flats in Craigshill by John Laing Ltd. Some of the first housing to be built in Livingston, the construction method used soon proved to be defective and suffered water penetration, despite several attempt at remedial measures, through until the 1980s.
The second major case involved the calculation of fees for consultancy work carried out by Zinn Hunter and Partners for a development plan for Livingston town centre which was never constructed. After fifteen years of dispute, the case was settled out of court in 1993. |
